Description

The Department of Industrial Relations is seeking to hire two student assistants for a Legal Student Assistant role. The Legal Student Assistant will assist with the processing, screening, investigation and settlement of the retaliation complaints. Typical duties will include interviewing witnesses, collecting evidence, meeting with employers, employees and their representatives, responding to public inquiries and conducting settlement conferences. A successful incumbent possesses exceptional interpersonal skills, analytical thinking, the ability to write well and enjoys practicing these skills through out the day.

Conditions of Employment

This is a part-time, temporary, non-benefited, student position. Employment in all positions with University Enterprises, Inc. is dependent upon the mutual consent of University Enterprises, Inc. and the employee. This means that either University Enterprises, Inc. or the employee can, at any time, terminate the employment relationship at will, with or without cause.

Depending on the type of position you are applying for, a pre-employment background check consisting of one or more of the following may be conducted : employment history, professional references, criminal check : educational verification (degree, license, or official transcript) or DMV clearance. Applicants will be required to pass required pre-employment checks to the satisfaction of University Enterprises, Inc. (UEI) and the hiring Agency or Department.

UEI does not allow students to hold more than one UEI Job at a time, or work in more than one account per pay period. UEI employees who are considering leaving their current UEI Student assistant position for a different UEI student assistant position should inform their supervisor in writing and provide at least a week's notice.

UEI is not a multi-state employer. UEI only employs candidates who live and work in the state of California. If selected for the position you must reside in California and all work must be performed in the state of California throughout the course of employment.

Prerequisites

Must be a college student attending classes during the regular term (fall, spring, and winter, if applicable), at one of the accredited colleges or universities on our affiliation list.

Students must be enrolled at a minimum in six-semester units or nine-quarter units for undergraduate students; four-semester units or six-quarter units for graduate students.

Students declared major must match the major(s) listed in the job posting.

Majors / Fields of Study

Current matriculation at an accredited law school.

Work Schedule

Flexible workdays and work hours, Monday - Friday, between 8 AM - 5 PM. Final work schedule to be determined by supervisor.

Additional Work Schedule

Graduate student assistant employees generally work up to 24 hours per workweek (Sunday - Saturday) during the academic year and up to 40 hours per workweek during breaks; (winter, spring, and summer).

M inimum Qualifications

  • Excellent verbal / written communication skills.
  • Proficient in Microsoft Office (Word, PowerPoint, Excel).
  • Responsible and dependable with a strong work ethic.
  • Must be able to interact with office staff in a friendly, professional manner.
  • Ability to take direction and work independently.
  • Ability to work cooperatively in a team environment.
  • Ability to set priorities and complete assignments within established timelines.
  • Ability to focus and minimize distractions.

Preferred Qualifications

  • Knowledge of : current social and economic developments and trends in California; problems of the culturally and economically disadvantaged; methods of compiling and presenting data; settlement, investigation and witness interview techniques.
  • Skill of : active listening; organization; time management; problem-solving; and critical thinking.
  • Ability to : interpret and apply State and Federal labor laws; prioritize multiple assignments; analyze testimony and evidence; deal tactfully, effectively, and impartially with the public; analyze data; and communicate effectively.
  • Individuals who are, or have been, a dependent child in foster care, a homeless youth, or a formerly incarcerated youth as defined by Government Code section 18220 are encouraged to apply and will be given priority. Please note that prior to appointment, individuals claiming preference under one of these categories will be required to furnish documentation establishing their eligibility.
  • Duties and Responsibilities

  • Review retaliation complaints and identify potential violations of the Labor Code, Industrial Welfare Commission (IWC) Orders, User Interface (UI) Code, Vehicle Code and Health and Safety Code under the Labor Commissioner's jurisdiction.
  • Conduct case intake.
  • Prepare casefiles for investigation.
  • Update party accounts.
  • Send letters.
  • Request documents.
  • Comply with regulatory requirements.
  • Conduct initial screening interviews of complainants to identify possible Labor Code violations.
  • Determine timeliness of filing, jurisdictional issues, and evaluate whether the complainant has alleged a prima facie case of retaliation.
  • Assist in investigating retaliation complaints by conducting investigative interviews.
  • Draft case notes and chronologies.
  • Request documents from parties.
  • Calculate lost wages and related damages.
  • Write investigative reports.
  • Review cases with supervisor and legal department.
  • Gather, research, and analyze information using state and federal registration sites.
  • Search court records to determine liable entities and ascertain relevant entity details to build case files.
  • Proofread determinations and reports as assigned for spelling, punctuation and grammatical errors and provide feedback to the author regarding suggested corrections.
  • Respond to inquiries by the public regarding case status by communicating appropriate information available in Salesforce or communicating with respective team members to obtain status.
  • Hold meetings with employers, employees and their representatives to explain and interpret
  • Labor Code sections and facilitate settlements and resolutions of disputes or claims with the parties either by telephone or at in-person conferences under Division policies and procedures.

  • Receive and process Public Record Act (PRA) requests for the program, including the assessment of information regarding case records requests on the database.
  • Redact, copy and provide requested State records to members of the public, pursuant to the PRA requirements.
  • Physical Requirements

    Sit for extended periods; frequently stand and walk; manual dexterity and hand-eye coordination; corrected hearing and vision to normal range; verbal communication; use of office equipment including computer workstations, telephones, calculators, copiers, printers, and scanners with or without reasonable accommodation.

    Work is performed in an office environment.
