- Job Overview
Increasingly, the class and representative actions that we file require that they be tried in a Court of law or before an arbitrator. The Trial & Arbitration Attorney (Trial Attorney) is responsible for working closely with our handling and managing attorneys to prepare matters for trial and / or an arbitration hearing, including assisting in making strategic decisions to position the matter for a successful evidentiary hearing; helping to plan and participate in key depositions leading up to an evidentiary hearing; coordinating with the Litigation Team and the Arbitration Team to prepare for the evidentiary hearing; and being the first chair on the evidentiary hearing (i.e., the trial in court and / or arbitration hearing before an arbitrator).
- Duties & Responsibilities
Pre-Trial & Pre-Arbitration Preparation
- Review pleadings, motions, discovery responses, deposition transcripts, and key evidence to assess strengths, weaknesses and trial themes.
- Develop comprehensive case strategies in collaboration with Managing Attorneys, Handling Attorneys and the Litigation / Arbitration Teams.
- Draft and argue substantive pre-trial / arbitration motions, including motions in limine, trial briefs, evidentiary motions, and arbitration-specific submissions.
- Prepare witness examinations, outlines, exhibit lists and demonstratives.
- Assist in identification, selection, and preparation of expert witnesses when relevant.
- Participate in and help lead mock examinations, witness preparation sessions, and trial strategy meetings.
Discovery and Depositions
- Plan, prepare for, and take or defend key depositions, including PMK witnesses, supervisors, HR personnel, corporate representatives, and expert witnesses.
- Coordinate with the Discovery Team to ensure that all necessary fact development is completed in advance of an evidentiary hearing.
- Identify, request, and organize documents critical for trial preparation (e.g., wage records, policies, electronic timekeeping data).
Trial / Arbitration Hearing Responsibilities
- Serve as first chair at trials and arbitration evidentiary hearings, responsible for presenting opening statements, conducting direct and cross examinations, arguing evidentiary issues, and delivering closing arguments.
- Manage the presentation of exhibits, demonstratives, digital evidence, and witness logistics.
- Think strategically and make real-time decisions during the evidentiary hearing to maximize results for the client.
- Maintain professionalism, courtroom presence, and persuasive advocacy throughout the hearing.
Case Strategy & Collaboration
- Work closely with Handling Attorneys to refine case theories, valuation, and trial / arbitration posture.
- Advise on settlement negotiations and participate in mediations as needed to help assess settlement leverage.
- Coordinate cross-departmentally to ensure alignment and readiness for hearing.
- Provide ongoing case updates to partners and senior attorneys, including risk analysis and recommendations.
Post-Trial / Post-Arbitration
- Stay current on developments in California employment law, arbitration rules, wage and- hour class action trends, and evidentiary standards.
- Participate in in-house trainings and contribute to improving internal trial preparation frameworks.
- Mentor junior attorneys and staff working on trial preparation tasks.
Requirements
- Juris Doctor degree from an accredited law school.
- Active membership in the California State Bar.
- At least 5 years of litigation experience in a law firm
- Prior experience in wage-and-hour litigation
- Experience as a first chair in multiple evidentiary hearings taking place in court and / or arbitration
- Proficiency with Microsoft Office Suite and legal research platforms.
- Strong drafting, analytical, and oral advocacy skills. xmcpwfu
- Excellent organizational and prioritization skills and ability to manage multiple matters simultaneously.
Preferred Qualifications
- Prior experience in wage-and-hour class actions and / or PAGA litigation
- Prior experience engaging in arbitration hearings before AAA, JAMS, Judicate West and other mainstream Arbitration forums
