General Job Description
The Senior Counsel –Debt Recovery position is targeted toward an experienced attorney who will be responsible for managing collections efforts in pursuit of commercial (non-consumer debt) debt recovery largely in the North American regions. This role will also perform ancillary matters related to commercial contracts, including advising internally on contract interpretation and the legal ramifications of contract terms as pertain to company’s debt collections rights. This role also will be directly involved in negotiating with counter parties and their counsel toward dispute resolution.
Position Summary
- Annual Salary Range : $80,000 - $100,000 commensurate with experience
- Additional 10% Performance Based Bonus

Responsibilities
The Senior Counsel – Debt Recovery position reports directly to the General Counsel and is responsible for handling a variety of routine assigned legal projects within the Legal Department, including but not limited to :
Provide support on legal matters and strategic questions, including negotiating, preparing or vetting and resolving legal issues related to debt collectionDevelop an understanding of the company’s business and legal issues, including its preferred positions on debt settlement negotiationsWork with closely company’s collections team to exchange information on customer-debtor background and payment history.Identify and implement process improvements to drive best practices and efficiencies as would relate to debt collection activities.Prepare demands for debt collection.Working with internal Legal operations to implement and follow the approved processes for selecting, instructing and managing external counsel, and monitoring all assignments effectively with appropriate reporting to the business and oversight of performance.Prepare cases for transfer to collections litigation counsel and assist with production related to discovery requests.Review court pleadings and discovery documentation.Attend depositions and mediation meetings.Participate in collections related dispute resolution negotiations directly with opposing counsel. where the company has not engaged outside litigation counsel.Communicate / coordinate with senior executive leadership on debt settlement negotiationsDraft and review Release and Settlement Agreements.Report on case progress to general counsel and senior executive leadership.Assist in protecting the company’s legal interest and ensure that its debt collections activities are in compliance with applicable law.Drafting, review, negotiation, and management of related commercial agreements and related documents, consistent with company policies and objectives. Advise leadership of associated risk / liability and devise strategies to minimize such risk.Maintain deadlines on deliverables and communicate with internal and external clients.Maintain accurate and updated reporting on collections matter status.Field and address legal questions and requests from internal teams relating to commercial collections mattersCommunicate and coordinate with company’s executive leadership team on company’s strategic initiatives as pertain to debt collection activities.Coordinate with other legal department attorneys to ensure coverage of case load.Obtain broad knowledge base in company’s other legal governance disciplines including but not limited to bankruptcy, commercial litigation, regulatory compliance, etc.Participate in management of bankruptcy matters including prepetition and post-petition claim filing.Provide other legal support as directed or as circumstances may require supporting management and protecting company’s legal interests.Participate in supervision and management of in-house legal assistants and administrative staffing support of the department’s legal and administrative functions.Build proficient skills with the legal department’s matter management system CounselLink®.Build proficient skills with the company’s accounts receivable management software and with its primary operating system software that is used to track company’s deliverables and generate billing records.Other related legal related duties, including but not limited to research and special projects as maybe assigned by company’s General Counsel and or company’s senior executives.Limited travel for periodic training and court mandated hearings.Maintain confidentiality of information; maintain a professional demeanor.Requirements :
Qualifications and Competencies
Bachelor's degree from an accredited 4-year college.Juris Doctorate Degree from an ABA accredited law school with bar admission in at least one U.S state.Excellent interpersonal, business, drafting, and writing skills are required with of one to four years of related negotiating experience.Customer Orientation Skill Set : Sensitive and responsive to internal and external customer needs; demonstrates skills in customer services and satisfaction; maintains a positive attitude, willing to listen to customer problems and seeks solutions; monitor changing needs of customers.Team Interactive Skill Set : Develops / maintains effective working relationships; listens attentively to others; communicates ideas clearly; excellent writing and editing skills; relates to people in an open / sincere manner; participates effectively in meetings; assists in finding solutions as well as identifying problems; communicates appropriately with supervisor and co-workers; shows composure under pressure.Strong analytical skills; detail oriented.Any other combination of skills, experience, and education as deemed appropriate by hiring manager.Ability to successfully achieve accreditation for jurisdictional privileges with the state of Tennessee as In-House Counsel.Computer Skills
Advanced personal computer skills including advanced knowledge of MS Office Suite, specifically Word, PowerPoint, and Excel, as well as the ability to learn other software as needed.Ability to routinely document work performance with the legal department’s matter management system.Legal research proficiency : Demonstrate minimum skills in legal research utilizing department’s subscription-based online legal research utilities.Preferred Experience
Experience with creditor’s rights, alternative dispute resolution, and commercial litigation. related to commercial debt collection.Experience working inhouse under corporate legal department preferred.Experience in the private sector preferred.Experience with bankruptcy laws and bankruptcy civil procedure a plus.Work Location
