Introduction to TALENT.COM Terms of Service

Every time you access or use TALENT․COM’s (defined below) online and/or mobile services, websites, applications, products or programs provided by, on behalf of, or in connection with TALENT․COM INC (“Collective Services”), you represent that you have read and agree to the Cookie Policy and Privacy Policy and further agree to our Terms of Service in effect with the entity or entities on the list below. Any references to “TALENT․COM,” “we,” or “our” in our Terms of Service shall mean the entity or entities applicable to you as set forth below:
  • Talent.com USA Inc., 125 S Wacker Dr., Chicago, Illinois 60606, United States, if and when you are in the United States,
  • Talent․com Colombia S.A.S., Cl. 67# 5220, 4026, Medellin, Antioquia 050010, Colombia, if and when you are supported primarily by our operations in Colombia or any other Latin American country,
  • Talent․com France SAS, if and when you are in France,
  • Talent․com Jobs Limited, if and when you are supported primarily by our operations in the United Kingdom,
  • Talent.com Europe Sàrl, Rue de Langallerie 9, 1003 Lausanne, Switzerland, when you are supported primarily by our operations in Switzerland or any European country (except for France and the UK),
  • TALENT․COM INC., 5800 St-Denis, 604, Montreal, QC H25 3L5, Canada, if and when you are in Canada and in all other respects.
TALENT․COM provides its Collective Services for personal (non-commercia for Job Seekers) purposes for individuals looking for employment or employment information (“Job Seekers”), for individuals and/or organizations looking to make employment opportunities available on their behalf or on behalf of others, including but not limited to agencies (“Employers”), and for individuals and/or organizations looking to make use of TALENT․COM’s Publisher services (“Publishers”). If you are accessing or using TALENT.COM website (“Site”) in your capacity as an employee or other representative of an Employer or Publisher, you are agreeing to this Agreement on behalf of yourself and such Employer or Publisher, as applicable, and you represent and warrant that you have the authority to bind such Employer or Publisher, as applicable, to this Agreement.
Special provisions for Job Seekers

1. Eligibility
To use TALENT.COM’s Services, you must be at least of the age required in your jurisdiction to access and use such services, and in all cases, you must be at least 13 years old. We will never knowingly solicit, nor will we accept, personally identifiable information from users known to be under thirteen (13) years of age.
You may agree to these Terms of Service only if you have reached the age of majority in your jurisdiction (generally 18 or older) or the legal age in your jurisdiction to form binding contracts under applicable law.
If you are under the legal age to form contracts in your jurisdiction, your parent, or guardian must agree to these Terms of Service on your behalf. TALENT.COM Parents and guardians are responsible for the acts of children under the age of majority when using our Services. We recommend that parents and guardians familiarize themselves with parental controls on devices they provide their child.
AS FAR AS IS PERMITTED BY APPLICABLE LAW, WE DECLINE ANY RESPONSIBILITY REGARDING ANY ACTIVITIES WHICH MAY BE CONDUCTED BY MINORS WITHOUT THE PERMISSION OF THEIR PARENTS OR LEGAL GUARDIANS. IF YOU ARE A PARENT OR LEGAL GUARDIAN AND YOU GIVE YOUR PERMISSION FOR YOUR CHILD TO REGISTER FOR ONE OR ALL OF OUR SERVICES, YOU THEREBY AGREE TO THE TERMS RELATING TO USE OF SUCH SERVICES BY YOUR CHILD.
TALENT.COM is for your personal, non-commercial use unless you enter into a separate agreement with us for your commercial use. You may not use TALENT.COM if we have terminated your account or banned you.
2. Your Talent Profile Account

2.1 Talent Profile Account
For you to create a Talent Profile account, we require that you provide your name, last name and a valid email address. The email you use must be one where we can reach you. In the event we cannot correspond with you via this email address, your submitted content may be rejected, and your account may be disabled.
Once you have set up a password, you will be given access to your profile and other private areas of your account. You are responsible for maintaining the confidentiality of your password. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
2.2 Social Sign Up and Sign In
You may be able to register an account and subsequently access Talent Profile through a social networking site, such as Facebook, LinkedIn or Gmail ("Social Networking Site"). If you access Talent Profile through a Social Networking Site you agree that we may access, make available through Talent Profile, and store (if applicable) any information, data, text, messages, tags, and/or other materials stored and made accessible in your Social Networking Site account so that it is available on and through TALENT.COM via your account and your Profile page. Subject to the privacy settings that you have set with the Social Networking Site account you use to access Talent Profile, personally identifiable information that you post to that Social Networking Site may be displayed on TALENT.COM such as name, last name, email address, phone number or location.
Please note: your relationship with your Social Networking Sites is governed solely by your agreement with those Social Networking Sites and we disclaim any liability for personally identifiable information that may be provided to us by a Social Networking Site in violation of terms and conditions of services of the Social Networking Site, of the privacy settings that you have set with that Social Networking Site account or of the laws applicable to the Social Networking Site.
IF YOU DON’T WANT US TO RECEIVE INFORMATION FROM YOUR SOCIAL NETWORKING SITES, DO NOT ACCESS TALENT.COM’S SERVICES THROUGH SUCH SOCIAL NETWORKING SITES.
3. Services

3.1 Job Listing
Talent Profile, which is free to those individuals searching for employment openings, may make available job posts advertising employment opportunities, including links to third-party websites, through TALENT.COM search results or otherwise through the Site.
You acknowledge and understand that TALENT.COM has no control over the content of job postings, or any conditions third parties might impose once a Job Seeker has applied or left the Site.
3.2 Applying on TALENT.COM
Any resume or application information that you submit through the Site, including Personal Data included in a resume, application or responses to screener questions, is subject to this Agreement and to TALENT.COM Privacy Policy. Once you provide information to an Employer (whether in the form of a job application, resume, email, or otherwise), TALENT.COM requires from Employers to keep this information confidential and only use it for the purpose of evaluating your application. However, TALENT.COM does not exert control on Employer’s use or disclosure of that information. If you want to request the Employer delete, modify, or maintain confidence over any such information, you must make such a request directly to the Employer.
TALENT.COM may use your application materials to determine whether you may be interested in a Job Listing, and TALENT.COM may reach out to you about such Job Listing. TALENT.COM may store such information for a reasonable amount of time, regardless of whether a Job Listing has been closed or is no longer available on the Site.
TALENT.COM does not guarantee the identity of an employer or any individuals working for any employers and cautions job seekers when applying to jobs. TALENT.COM does not guarantee the validity of a job offer and cautions job seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations. You are solely responsible for verifying the accuracy of any employer or job offer.
BY PROVIDING TALENT.COM WITH YOUR RESUME, YOU AGREE THAT TALENT.COM MAY BE SHARING THIS RESUME AND INFORMATION CONTAINED THEREWITH WITH EMPLOYERS.
4. Communications

4.1 Contact with You by Email
By providing TALENT.COM your email address, you consent to our using the email address to send you Service-related and other non-commercial notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service. If you consented to receive email job alerts or marketing communications from us, we will send you such communications until you opt-out. If you do not want to receive job alerts or marketing communications from us, (a) you may opt-out or change your preferences in your Talent Profile Account page, (b) by following the opt-out and/or unsubscribe instructions in the email message, (c) or by requesting to be opted-out by contacting our Customer Service department at [email protected] and/or our Data Protection Officer at [email protected].
Please note, that while you can opt-out of marketing messages and email job alerts, you cannot opt-out of service-related communications, including those related to security, legal notices, your account, or your use of our Services unless you deactivate your account and stop using our Services.
4.2 Contact with You by Phone
If you reside in the United States and the United Kingdom and wish to subscribe to our phone job alert service, the following terms apply to you.
4.2.1. SMS Job Alert Service
By subscribing to SMS Alert service, you certify that you are the owner of the mobile phone entered or are authorized to use this mobile phone to receive our text messages. You understand you are responsible for checking your mobile carrier plan for further details, and to pay any potential extra charges related to this service as standard message and data rates may apply.
You further understand and agree that by entering and submitting your phone number in our subscription form, you expressly consent to receiving text message communications from TALENT.COM via such mobile number. You will first receive a text message with a 4-digit verification code that you need to enter to confirm your subscription. Once you enter the verification code, you will receive a text message saying you have successfully opted into our SMS Alerts. However, response time may be delayed due to the high number of requests we receive, among others.
The number of messages you receive may vary depending on the number of recent jobs matching your search, the jobs you applied to, and if you sent us a message asking us for extra support via text message. Your carrier may charge fees for you to receive messages and may set limits to the number of messages you may receive, which are solely govern by the agreement you have with your carrier. You are responsible to maintain sufficient number of messages availability in order to receive the SMS Alerts. TALENT.COM is not responsible for undelivered messages caused by any restriction linked to the plan and mobile carrier you have. The supported carriers are not liable for delayed or undelivered messages.
If you are in the U.S you can revoke consent at any time by (a) texting STOP to +1 (844) 794-9497 via your mobile device, (b) by replying STOP to a text message you have received from TALENT.COM via your mobile device, (c) by unsubscribing from SMS Alerts in your Talent Profile Account under "My Notifications", (d) by contacting our Customer Service department at [email protected], and/or our Data Protection Officer at [email protected], (e) and/or by closing your Talent Profile Account. If you are in the U.K you can revoke consent at any time by (a) clicking on the unsubscribe link you received from TALENT.COM via your mobile device, (b) by unsubscribing from SMS Alerts in your Talent Profile Account under "My Notifications", (d) by contacting our Customer Service department at [email protected], and/or our Data Protection Officer at [email protected], (e) and/or by closing your Talent Profile Account. Once our team has reviewed your request, we will send you a message confirming that your contact information has been removed from our system.
4.2.2. WhatsApp Job Alert Service
By agreeing to these terms and subscribing to WhatsApp Job Alerts, you certify that you are the owner of the mobile phone entered or are authorized to use this mobile phone to receive our WhatsApp Job Alerts. You acknowledge that your relationship with WhatsApp is governed solely by your agreement with WhatsApp. We disclaim any liability for personally identifiable information that may be provided to us by WhatsApp in violation of the privacy settings that you have set with WhatsApp, of their terms and conditions of services, or of the laws applicable to them.
By entering and submitting your phone number in our subscription form, you agree to receive job alerts communications from TALENT.COM via WhatsApp. You will first receive a message with a link to verify the number. Once you click on the link you will be redirected to TALENT.COM where you will receive a message saying you have successfully opted into our WhatsApp Job Alerts.
The number of messages you receive may vary depending on the number of recent jobs matching your search, the jobs you applied to, and if you sent us a message asking us for extra support via WhatsApp message. Your carrier may charge fees for the bandwidth required to receive such information through the web; you are responsible to maintain sufficient web bandwidth in order to receive WhatsApp messages.
If you do not want to receive communications from TALENT.COM via WhatsApp, you may make such a request: (a) with respect to WhatsApp text messages, by replying "STOP" via WhatsApp; (b) by selecting unsubscribe from WhatsApp job alerts in your account under "My Notifications"; (c) by writing us at [email protected] or at [email protected]; and/or by closing your Talent Profile Account.
Special Provisions Applicable to Employers

1. Your Talent Post Account
When you create a Talent Post account, or post job listings, advertising employment opportunities, and other job-related contents, including links to third-party websites (“Job Listings” or “Job Ads”) on the Site, whether as part of the TALENT.COM Ads Program or otherwise, you agree that this Agreement, the terms associated with any TALENT.COM service you are using, and all of TALENT.COM’s policies, including the TALENT.COM Privacy Policy and Cookie Policy, apply to you.
When you create a TALENT.COM for Employers account, TALENT.COM may require that you verify your identity via phone number identification.
As an Employer, your account is for business use and not for personal use. TALENT.COM is not responsible for and disclaims all liability if your email is used improperly or falsely by a third party. By registering for a Talent Post account, you agree to receive mandatory email updates regarding anomalous activity to your Talent Post account. If you attempt to send an email from a name or email address that is not true, accurate, current or complete, we reserve the right to drop such email, and attempting to send such email is a violation of our terms.
If you have provided a billing address to us, and you change such billing address, you may still receive billing and information at your previous address for the remainder of the billing period in which you made the change.
2. Services
You also agree that, as a service to Job Seekers, we may activate its Talent Apply relay function for use in connection with your Job Listings, and that any Job Seekers who wish to indicate an interest in such Job Listing may only do so through Talent Apply. When you use Talent Post, you acknowledge and agree that TALENT.COM may make available functions allowing you to take actions regarding the Job Seeker, such as viewing and downloading a resume. You agree that by using Talent Post, you are instructing TALENT.COM to assemble the candidate’s application materials, resume, answers to screener questions, and other information you provide to TALENT.COM. You further agree that TALENT.COM is not responsible for maintaining or storing such application materials on your behalf, and that you are responsible for your own compliance with any applicable record retention requirements. By using Talent Post, you are providing information to TALENT.COM and requesting and authorizing us to make available such information to the applicable Job Seeker. Additionally, you consent to any information shared through TALENT.COM might be processed and analyzed by TALENT.COM according to this Agreement and our Privacy Policy. TALENT.COM may store such information regardless of whether a job vacancy has been filled.
You are responsible for the contents of your application form, screener questions, and any Job Listings that you post, or otherwise, and agree that TALENT.COM is not responsible for such content and disclaims all liability for such content, including as to whether such content is legal. You further agree that you might not post any job ad that:
  • Does not comply with the applicable laws or regulations of the state and country where the job is to be performed, including laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use and intellectual property;
  • Contains false information or solicits employees by intentional misrepresentation, such as, misrepresentation of the terms of employment, the hiring entity, or the identity of the poster;
  • Does not contain the company name;
  • Requires an application fee or up-front or periodic payments; requires recruitment of others that include but are not limited to training ; resembles a multi-level marketing scheme, franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement; or only pays commissions (except where the listing makes clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling), or job ads that do not fill an employer vacancy;
  • Involves any screening requirement where such screening requirement is not an actual and legal requirement of the advertised position;
  • Contains any logo or brands, or link to website, other than your own or those of any entity for which you are authorized to submit job ads;
  • Contains multiple job openings in a single job ad;
  • Contains generic, misleading, or deceptive information;
  • Requires the Job Seeker to apply outside of the Site;
  • Discriminates against applicants based on gender, race, religion, sexual orientation, age, disability, or any other ground(s) prohibited by applicable law, in each case as determined in TALENT.COM 's reasonable discretion.
You agree that TALENT.COM may, at its sole discretion, remove or prevent the posting of any job ad for reasonable reasons from Talent Post, the Site, and all other traffic sources as we may deem appropriate. We reserve the right to edit the job title and correct the job location to optimize the listing as appropriate without notifying you.
You acknowledge and agree that TALENT.COM may also send emails to Job Seekers indicating that your Job Listing is potentially a match for the Job Seeker’s resume.
You agree that TALENT.COM may take action to try to identify and reduce spam applications, and that TALENT.COM does not verify the identity of any Job Seekers who apply to your job listing, nor does TALENT.COM know a Job Seeker’s motivation for applying to your job listing, and thus provides no guarantee as to the Job Seeker’s qualifications or interest in your job listing. You agree that Talent Apply and TALENT.COM’s relay functions are presented to you without warranty and TALENT.COM assumes no responsibility for the communications between you and the Job Seeker, which communications are yours’ and the Job Seekers’ sole responsibility.
You shall indemnify, defend and hold harmless TALENT.COM, its agents, affiliates, and licensors from any third-party claim or liability (including without limitation reasonable legal fees) arising out of any Job Listing or screener questions (or answers thereto) posted by you.
TALENT.COM may make Job Ad analytics data available on a Company Page or elsewhere on the Site and may provide analytics data regarding your Employer account to anyone at your company at TALENT.COM’s discretion. To the extent permitted by law, if you have an unpaid or outstanding invoice or account balance for any TALENT.COM product, TALENT.COM reserves the right to suspend or terminate your use of that TALENT.COM product as well as any other TALENT.COM product, including but not limited to those TALENT.COM products where you do not have an unpaid invoice or account balance.
When you view, send, or store materials (including Job Listings and resumes,) through or using the Site, TALENT.COM may, for example, use such materials for data analysis, quality control, or to refine the Site or any other TALENT.COM product or service (including to provide better search results and other listings for Job Seekers and Employers), whether via automated means or otherwise.
WHEN YOU RECEIVE PERSONAL INFORMATION FROM JOB SEEKERS, YOU MUST ONLY USE IT FOR THE PURPOSE OF YOUR OWN HIRING PROCESS, AND IN NO CASE RESELL IT TO THIRD PARTIES OR USE IT FOR MASS-MAILING PURPOSES. IN ALL CASES, YOU MUST COMPLY WITH APPLICABLE LAWS, INCLUDING, WITHOUT LIMITATION, REGARDING PRIVACY AND THE HIRING PROCESS.
3. Payment
If you buy any of our paid Services, you agree to pay us the applicable fees and taxes specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that:
  • Your payment method automatically will be charged at the end of every billing cycle (7 days) for the duration of the service period for the fees and taxes applicable to that period. Please note that if you wish to add 2 or more different payment methods, such as having 2 or more credit cards, the billing cycle for each could differ depending on the day you submitted your credit card for payment;
  • Any payments made by credit card are subject to the approval of our financial partner. A $0.50 fee will be applicable at the time of the credit card verification, which will be automatically refunded by TALENT.COM once the validation has been made.
  • You waive all claims relating to charges unless claimed within 60 days after the charge (this does not affect your credit card issuer rights);
  • You acknowledge and agree that any credit card and related billing and payment information that you provide to TALENT.COM’s may be shared by TALENT.COM with companies who work on TALENT.COM’s behalf, such as payment processors and/or credit agencies, solely for the purposes of checking credit, effecting payment to TALENT.COM and servicing your account. TALENT.COM may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims.
4. Communications
You may receive messages, emails or email notifications corresponding with your account or a Job Seeker’s activity or any other communications service, product, or feature provided on or through the Site.
For example, if you post a Job Listing directly on TALENT.COM, applications are sent only to your Talent Post dashboard; any other notifications you may receive are provided solely as a courtesy to you.
If you no longer wish to receive job alerts from TALENT.COM you can unsubscribe at any time by accessing your Talent Profile account or contacting our Customer Support team at [email protected].
Terms of Service for all Users

1. Content
All the jobs contained in TALENT.COM's search results, or linked from those results, have been provided by external websites over whom TALENT.COM exercises no control. TALENT.COM automatically indexes all the jobs from external sources and assumes no responsibility for the content of any job listing.
We do not claim ownership in any Content such as resumes or job postings that you submit or authorize for use to TALENT.COM, but you grant us the rights to use such Content as set forth below.
You should only submit Content to TALENT.COM that you are comfortable sharing with others under the terms and conditions of these Terms.
2. Rules of Conduct
You represent and warrant that you will use TALENT.COM solely for lawful purposes in a manner consistent with these Terms and any and all applicable laws, regulations, or other legally enforceable obligations (including contractual obligations) you may have towards us and any third parties. You are solely responsible for any and all Content that is posted through your account on TALENT.COM ("Your Content").
Without limiting its rights of section 2 hereinabove, TALENT.COM reserves the right to remove without notice Your Content (in whole or in part) if it includes, in our sole opinion, defamatory, derogatory, offensive, or illegal content.
3. Guarantee
TALENT.COM's team is working hard to maintain a high quality of indexed jobs. Because we index a lot of content, we cannot guarantee the validity and genuineness of all the jobs we index. If you find any jobs that look "spammy", "fishy" or "expired", please at [email protected]. Our team will investigate and take action to fix the problem swiftly.
4. Indexing of TALENT.COM
We do not allow the automatic indexing/crawling of TALENT.COM's search results outside of the rules provided by our robots.txt file. (See talent.com/robots.txt).
5. Disclaimer & Liability
TALENT.COM IS NOT LIABLE FOR ANY KIND OF PHYSICAL, FINANCIAL OR PSYCHOLOGICAL DAMAGE CAUSED BY THE USE OF ANY OF OUR SERVICES OR CAUSED BY INACCURATE, INVALID, FALSE OR EXPIRED JOBS OPPORTUNITIES. If you find content on TALENT.COM’s website that could be potentially harmful, please contact us at [email protected]. Our team will investigate and take action to fix the problem swiftly.
6. Governing law and trial by jury
This Agreement shall be construed and interpreted in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein and shall be treated in all respects as a Quebec contract, without reference to principles of conflict of law.
Wherever the right to a trial by jury may be waived, you also hereby waive any right to a jury trial in connection with any action or litigation in any way arising out of or related to your use of the Site or these terms of service.
7. Class Action Waiver
By using the Site and in return for the services offered by TALENT.COM, you acknowledge that TALENT.COM can only offer you these services under the terms and conditions as presented herein. As partial consideration for your use of the Site and these services, where permitted by law, you agree not to sue TALENT.COM as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against TALENT.COM regarding your use of the Site. If you do not agree to any part of these terms, do not continue your use of the Site. Nothing in this paragraph, however, limits your rights to bring a lawsuit as an individual plaintiff, including in small claims court.
8. Arbitration Agreement
PLEASE READ THIS ARBITRATION PROVISION CAREFULLY. IT AFFECTS YOUR RIGHTS, AND THE RIGHTS OF THOSE TO WHOM YOU PROVIDE ACCESS TO YOUR ACCOUNT. THE AGREEMENT TO ARBITRATE ALL CLAIMS IS A CONDITION OF YOUR USE OF TALENT.COM'S SERVICES AND WEBSITE.
Wherever permitted by law, you (on your behalf and on behalf of anyone who uses your account) agree to resolve all disputes with or involving TALENT.COM by final and binding arbitration of all claims before the American Arbitration Association, except dispute within the jurisdiction of the applicable small claims court, disputes involving TALENT.COM's intellectual property rights, or disputes required to be excluded from arbitration by applicable law. You also agree that the arbitrator shall have the power to rule on his or her own jurisdiction, including any objections with respect to the existence, scope, or the validity of the arbitration agreement. Further, you agree that: (a) Federal Arbitration Act governs; (b) THAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL, NON-CLASS, AND NON-REPRESENTATIVE CAPACITY, AND THAT CLAIMS OF TWO OR MORE PERSONS MAY NOT BE JOINED OR CONSOLIDATED ABSENT CONSENT OF TALENT.COM; and (c) TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TALENT.COM HEREBY WAIVE THEIR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JURY, EVEN FOR DISPUTES NOT SUBJECT TO ARBITRATION.
You can decline this arbitration agreement by timely emailing us and providing the following information: (1) your name; (2) your address; (3) your phone number; and (4) a clear statement that you wish to opt out of this arbitration agreement. To be effective, the opt-out notice must be emailed no later than 30 days after the date you become bound by the arbitration agreement. Please note that you will continue to be bound by any older arbitration provision you did not out opt of and any arbitration provision that otherwise governs your relationship with TALENT.COM.
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision shall be severed, and the remaining arbitration terms shall be enforced, except that if the class action waiver above is found unenforceable, the entire arbitration agreement is void.
9. Severance
If any provision of these terms is found unenforceable, the unenforceable provision shall be severed, and the remaining terms shall be enforced.
10. Termination
These Terms remain in effect while you use TALENT.COM and, for registered users, as long as your account remains open. You may delete your account at any time. We may suspend or terminate your account or your access to parts of TALENT.COM, for any reasonable motives. We will have no liability whatsoever to you for any deletion of your information.
All provisions of these Terms shall survive termination or expiration of these Terms except those provisions granting access to or use of TALENT.COM. For the avoidance of doubt, you agree that these Terms apply to your use of TALENT.COM and any Content posted on TALENT.COM at any time prior to the termination or expiration of these Terms.

Here’s what you need to know about our security measures:
1. Protection
We continuously test our system for potential breaches and and have developed a Bug Bounty program that proactively encourages and rewards third parties for identifying security vulnerabilities on our site. We have dedicated resources monitoring our servers for any potential intrusions or vulnerabilities. We encrypt our data while stored and in transit and have strict access control policies within our organization to control access to the data. No system is 100% secure, so we dedicate resources to ensure that we minimize the risk of leaks, breaches, or hacks.
2. Links
As a search engine, most clicks will forward users to the source website. We do our best to remove sources containing malware, excessive advertising, phishing strategies, or any other method potentially harming our users or degrading their job search experience. If you run into a link that contains any of these qualities, please contact us. We will investigate and take action swiftly.

This information allows us to provide quality job search results and eliminate the need for you to enter the same information multiple times. We use cookies to recognize you (your IP address and browser) when you visit our websites. 3.1 Google Analytics
We use the web analysis service Google Analytics to help us analyze your use of our websites through cookies. 3.2 Google Ads and Remarketing Lists
Our websites also use cookies for Google Ads and Remarketing Lists, which are features of Google Analytics for Display Advertisers. How it works is that, after using our services, when you visit other websites you may see targeted ads about jobs from Talent.com thanks to cookies that indicate you are part of a group of users that have visited our websites. For example, if you searched for “delivery driver jobs” while on Talent.com, when visiting other websites, our partners, such as Google and Facebook, can use this information to improve the relevancy of ads we may display on other platforms you visit. 3.3 Facebook Pixel
Facebook Pixel is a similar technology we use that stores information in cookies that allows us to display targeted ads to you after you have shown an interest in our websites and/or our Facebook ads related to jobs. This cookie information is shared between Talent.com and Facebook. The Facebook pixel cookies saying you visited our website are transmitted to Facebook servers and assigned to your personal account, telling Facebook that you have an interest in seeing ads related to jobs. 4. Duration of Storage and Possibility of Objection and Removal:
Cookies are stored on your computer and transmitted between your browser and websites. Session Cookies are temporary and only remain until you leave our websites. Persistent cookies can remain in your browser cookie file for longer, varying periods of time depending on their use. You can adjust your Internet browser settings to deactivate or restrict the transmission of cookies. Already stored cookies can be deleted from your browser at any time. This can also be done automatically.

1. About this Privacy Policy
This Privacy Policy describes how Talent.com Inc. (“Talent.com”, “we”, “our” or “us”) and our affiliates handle the data collected and processed using our websites (the “Website”), our mobile applications and our products and services (together, the “Services”).
If you do not accept this Privacy Policy or do not meet or comply with the provisions set forth herein, then you should not use our Services. 
2. Who Controls Your Data
Talent.com is a global company based in Canada. Talent.com controls the data collected and processed through our Services.
In certain instances, Talent.com acts as a data processor to its clients and is provided Personal Data by such clients acting as the data controller. In such case, we process Personal Data under the direction of that client and have no direct relationship with the individuals whose Personal Data we process. Talent.com may also act as a data processor on behalf of its affiliates. For more information, see Section 4 of this Privacy Policy.
3. Types of Data We Collect
Depending on your interaction with us, meaning, if you are a visitor browsing our Website, or if you have registered as a user of our Services, either as a job seeker (“Job Seeker”) or as someone looking to hire or make available information regarding employment openings (“Job Advertisements”) on your behalf and/or other’s behalf (“Employer”), we collect and process two types of information about you:
Personal Data: The is the type of data that identifies you as a natural person, or that may be used, either alone or in combination with other information, to personally identify you as a natural person. Such information may include:
  • Your first name, last name, Social Media profile or similar identifier (“Identity Data”)
  • Your physical address, email address, social media address, mobile or landline telephone number, location data and other contact information you may provide (“Contact Data”)
  • Your username and password, user preferences, profile-linked user-generated content such as Job Advertisements, curriculum vitae (CV)/resume, job searches (keyword(s) and location typed in the search bar or displayed on the job posting), candidate searches, feedback and survey responses (“Profile Data”)
  • Your applicant-linked user-generated content such as job applications, curriculum vitae (CV)/resume, cover letter and answers to employers screening questions (“Application Data”).
  • Details about your subscription to our Service and payments for such Services (“Transaction Data”) and billing, banking and payment card information (“Financial Data”). However, please note that credit card numbers are not collected by us directly, but by secure payment service providers.
  • Certain technical data about the equipment you use to access our Services (“Technical Data”) and the way you use our Services (“Usage Data”). This Technical and Usage Data may be considered Personal Data in certain jurisdictions. We refer you to Section 4 of this Privacy Policy for more information about Technical Data and Usage Data.
Non-Personal Data: This is the type of data that is non-personal and non-identifiable data that cannot personally identify or lead to identifying a natural person. For example, statistics or aggregated information, or any other type of data that can no longer be attributed to you. In the event we combine Personal Data with Non-Personal Data, the combined information will be treated as Personal Data for as long as it remains combined.
Sensitive Personal Data: To use our Services, you are not required to provide us with any Sensitive Personal Data. Sensitive Personal Data includes, for example, information about racial or ethnic origin, political opinions, religious beliefs, philosophical beliefs or trade union membership, genetic and biometric data and data concerning health, sex life or sexual orientation. If you are a Job Seeker responding to a Job Advertisement, sharing your resume with a prospective Employer or answering questions from a prospective Employer while using our Services, please carefully consider the information that you share and ensure that you are not providing any Sensitive Personal Data or other information that is not necessary for your job application or job search.
You are not required by law to provide us with any information. You can always avoid providing us certain Personal Data; however, you acknowledge that it may prevent us from providing you certain Services. 
4. How Personal Data and Non-Personal Data is Collected and Why
Personal Data communicated by Employers
When you are using our Services as an Employer, you may provide your Identity Data, Contact Data, Profile Data, Transaction Data and Financial Data to us when you:
  • create an employer account
  • post or distribute Job Advertisement using our Services
  • if you opt in to receive newsletters or other communications about new or existing features or functionalities that might be of interest to you
  • request information to be sent to you
  • use our customer service or support, or make technical request
  • provide feedback to us or respond to a survey
  • when you communicate with us on any transactional or other matters
In those circumstances, we use your Personal Data for our legitimate interest and to perform the Services you have requested or to respond to your inquiries and provide you with the support or information you have asked to receive. When you communicate with us over the phone, your calls may be recorded and analyzed for training, quality control and for sales and marketing purposes. During such calls we will notify you of the recording via either voice prompt or script. When you participate in a survey, we collect information that you provide through the survey. If the survey is provided by a third-party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information. Participation in any such surveys is completely voluntary and you, therefore, have a choice whether to disclose such information. 
Personal Data communicated by Job Seekers
When you are using our Services as a Job Seeker, you may provide us with your Identity Data, Contact Data, Profile Data and Application Data when you:
  • create an employer account
  • sign up for job alerts
  • apply to a Job Advertisement posted on our Website, mobile application or through sponsored advertisements that we have on third party sites
  • use our customer service or support, or make technical request
  • provide feedback to us or respond to a survey
In those circumstances, we use your Personal Data for our legitimate interest and to perform the Services your have requested or to respond to your inquiries and provide you with the support or information you have asked to receive. When you subscribe to our email or SMS job alerts, we use your email or phone number, based on your consent, to send you personalized and relevant job listings related to your job search. You may manage your alerts or unsubscribe at any time from our job alerts Services. See Section 8 of this Privacy Policy for details on how to unsubscribe to our Services.
When you apply for a job through our Website or mobile application, we collect and use your Application Data, based on your consent, to send to the Employer whose Job Advertisement you responded to. This data is then associated with your Job Seeker account, so you can easily apply for subsequent jobs without having to re-enter your application information every time. Sometimes, when applying for a job, you may be redirected to the Employer’s website or application tracking system. In such a case, we do not collect your Application Data. We process it on behalf of the Employer.
Personal and Non-Personal Data automatically collected from you
As you interact with our Website or use our mobile application, we may automatically collect technical data about your computer and mobile device. This may include information such as Internet Protocol (IP) address (a number that is automatically assigned to a computer when the Internet is used) and other device identifier, your login data, access dates and times, browser type and version, device information, cookie data, time zone setting and location data, browser plug-in types and versions, operating system and platform, mobile phone carrier identification, the language your system uses and other technology on the devices you use to access our Services. We refer to this as “Technical Data”. We may also collect information about how you use our Services, such as your browsing actions and patterns, which links you click on, or information that you type into pages or forms we present to you. If you receive email or other form of electronic communication from us, we use certain tools to capture data related to when you open our messages, click on any links or banners it contains and subscribe to our Services. We refer to this as “Usage Data”.
We collect this Technical and Usage Data by using cookies, pixels, server logs and other similar technologies. “Cookies” are small pieces of information that a website sends to a computer’s hard drive while a website is viewed. We may also receive Technical Data and Usage Data about you if you visit other websites employing our cookies and other similar technologies, including on third party websites where we publish Job Advertisements. We have a legitimate interest in collecting Technical Data and Usage Data as this allows us to make our Website and mobile applications operate efficiently, to improve our Services, to monitor, detect and prevent fraudulent activities on our Website, to provide you with service offerings that you might find most useful and help us understand which of our Services is the most popular.
Personal Data we receive from third parties
We may receive Personal Data in the form of Technical Data and Usage Data about you from various third-parties such as analytics providers. We may also participate in behavior-based advertising. This means that a third party uses technology (e.g., a cookie) to collect information about your use of our Website so that they can provide advertising about products and services tailored to your interests on our Website, or on other websites. However, these non-essential/third party cookies will not be deployed until you specifically consent to their use through a separate opt-in consent mechanism.
You may also create an account or log into your Talent.com account using third-party websites including, but not limited to LinkedIn, Facebook, or Google (“Social Media”). If you do not already have a Talent.com account but log into Talent.com using your Social Media account, this creates a Talent.com account using the same email address used in your Social Media account. If you agree to provide this information to Talent.com, your Social Media account will authenticate you and redirect you to Talent.com. Please note, when you log into Talent.com using your Social Media account, these Social Media will cookie you in order to authenticate you as a Social Media user.
By accessing Talent.com through your Social Media account, you understand that these Social Media providers will share certain data detailed in the above paragraph for the purposes of authentication to permit you to access our Website in a secure manner. You may stop this at any point from your Social Media account. This information will be considered Talent.com account information for purposes of your use of our Services.
When Talent.com acts as a data processor
Where Talent.com processes your Personal Data in the capacity of a data processor, and you seek access, or want to correct, amend, or delete your Personal Data, or have other requests, we will provide you with the data controller’s contact information, so you can contact them directly. In rare instances, however, circumstances may necessitate Talent.com to assist you with your question or request.
Personal Data that we process as a data processor is retained by us only for the duration required to service the data controller client, and/or in accordance with the instructions from such client, and/or as necessary to comply with our legal obligations.
5. Sharing of Personal and Non-Personal Data
In addition to the specific situations discussed elsewhere in this Privacy Policy, we may share Personal Data in the following situations: 
  • Job Seekers and Employers. When a Job Seeker applies for a job through our Website or mobile application, we share their Application Data with the Employer. This may include sharing the Application Data with the employer looking to hire, the agency recruiting on behalf of the employer and/or the external system such as an applicant tracking system used by the employer and/or the agency to manage the hiring of employees. Employer account holders agree to comply with all their responsibilities under applicable data protection laws with respect to the collection, processing and storage of Personal Data, as well as providing adequate protection of all data subject rights provided for under all applicable data protection laws. When an Employer uses our Services, we will share Employer-related information with Job Seekers. This may include publishing Job Advertisements, company pages, and salary information on our Website and mobile applications. We may also share this information on third-party websites.
  • Service providers. We share your information with service providers that we use to support our business or help provide our Services to you, including, but not limited to, third-parties that host our Website, assist us to verify your identity, perform website and platform maintenance, risk assessments, and security, perform data and web analytics, provide databases, IT services, customer service, payment platforms and credit card processing, communication services, and email services. Our service providers will be given access to your Personal Data as is reasonably necessary to provide the Website and related Services. Our service providers are contractually obligated to use your Personal Data only at our direction, to handle your Personal Data in confidence, and to not disclose your Personal Data to unauthorized third parties. However, certain of those service providers provide services pursuant to standard terms and conditions that may be non-negotiable. These service providers have informed us or the general public that they apply security measures they consider adequate for the protection of information within their system, or they have a general reputation for applying such measures. However, we will not be liable (to the fullest extent permitted by law) for any damages that may result from the misuse of any information, including Personal Data, by these companies.
  • Affiliates and acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage. 
  • Other disclosures with your consent.  We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Privacy Policy.
  • Other disclosures without your consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third-party intermediary.
  • Public. Some of our websites may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, that information may be publicly available. 
Except as otherwise stated in this Privacy Notice, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Data with third parties without your consent. We may use or share Non-Personal Data in any of the above circumstances, as well as for the purpose of providing and improving our Service and for commercial use.
6. Retention of your Personal Data
The length of time for which we retain Personal Data depends on the purposes for which we collected and use it and/or as required to comply with applicable laws. Where there are technical limitations that prevent deletion or anonymization, we safeguard Personal Data and limit active use of it. See the Section 8 about the storage of your Personal Data.
7. How We Protect your Personal Data
We implement security measures designed to protect your Personal Data from unauthorized access. We apply these tools based on the sensitivity of the Personal Data we collect, use, and store, and the current state of technology. We protect your Personal Data through technical and organizational security measures to minimize risks associated with data loss, misuse, unauthorized access, and unauthorize disclosure and alteration. We periodically review our information collection, storage and processing practices, including technical and organizational measures, to guard against unauthorized access to systems.  Your account is protected by your account password and we urge you to take steps to keep your Personal Data safe by not disclosing your password and by logging out of your account after each use.  
Because the internet is not a completely secure environment, we cannot warrant the security of any information you transmit to us or guarantee that information on the Website may not be accessed, disclosed, altered and/or destroyed by breach of any of our physical, technical and/or managerial safeguards. In addition, while we take reasonable measure to ensure that service providers keep your information confidential and secure, such service provider’s practices are ultimately beyond our control. 
We are not responsible for the functionality, privacy and/or security measures of any other organization. By using our Website, you acknowledge that you understand and agree to assume these risks. You may ask for a list of technical and organizational measures taken to protect your Personal Data by e-mailing us at: [email protected].
8. Your choices
You may take the below actions to change or limit the collection or use of your Personal Data. 
  • Unsubscribe to Job Alerts. If you wish to unsubscribe to job alerts, you may do so by clicking on the “Unsubscribe from Job Alert” link located at the bottom of any email alert. You can then click on the “Delete” button next to the alert you wish to remove. In the case of SMS or WhatsApp Job Alerts, if offered in your region, you can unsubscribe by replying “STOP” to the messages you received or clicking on the unsubscribe link you received via your mobile device, as the case may be. You may also edit or unsubscribe to job alerts in your account profile, under the “My notifications” tab.
  • Unsubscribe to promotional/marketing emails. You may choose to provide us with your email address for the purpose of allowing us to send offers and other promotional/marketing materials to you, as well as targeted offers from third parties. You can stop receiving promotional/marketing emails by following the unsubscribe instructions in e-mails that you receive and also adjust your email preferences in the “My notifications” tab in your account profile. If you decline to receive promotional and/or marketing emails, we may still send you transactional and Service-related messages.
  • Purge your account. If you wish to delete all information associated with your account, you may do so by logging into your account, clicking on the “Settings” section, and then on “Purge my account information”. You will no longer have access to any of the data we make available under that account, including but not limited to, search history, job search preferences, saved jobs, jobs that you have applied to, Job Alerts, resume, and any other data associated with the account. You should note that we reserve the right to keep any materials in a closed account as necessary to preserve and protect our rights to the extent permitted by law (for example, to preserve records of a dispute) or to comply with our obligations under local law (for example, if requested to retain by law enforcement). A closed account does not mean that all of the data is expunged from our systems, although it will not be readily available under your original account. You should also realize that when you apply for a job through our Website or mobile application and you purge you account thereafter, the job application may still be accessible to the Employer who received it, as well as any messages sent to or received from you. If you are a Job Seeker and want to delete a job application performed from our Website, please note that your applications and materials may be controlled by an Employer and we may direct you to that Employer for Personal Data deletion requests where that Personal Data is held by that Employer.
  • Device and usage information. If you do not want us to see your device location, you can turn off location sharing on your device, change your device privacy settings, or decline to share location on your browser.
9. Your Privacy Rights
Under the European Union (“EU”) General Data Protection Regulation (“GDPR”), EU residents have certain rights with respect to their Personal Data. We provide GDPR-type rights to all our users globally. You can make the following choices regarding your Personal Data:
  • Access to your Personal Data. You may request access to your personal information by contacting us at the address described below. If required by law, upon request, we will grant you reasonable access to the personal information that we have about you. We will provide this information in a portable format, if required. 
  • Changes to your Personal Data. We rely on you to update and correct your Personal Data. Our Website allows you to modify or delete your account profile. If our Website does not permit you to update or correct certain information, you may contact us at the address described below in order to request that your information be modified. Note that we may keep historical information in our backup files as permitted by law.
  • Objections/restrictions to your Personal Data.  You have the right to object to how Personal Data is processed in relation to public interest/official authority and our legitimate interests as well as direct marketing purposes – including profiling under both. You also have the right to request that processing of your Personal Data be restricted where its accuracy or lawfulness is contested, you need it in response to legal claims or in relation to verification as to whether legitimate interests for processing exist.
  • Deletion of your Personal Data. Typically, we retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Where certain grounds apply, the law authorizes you to make a request that your personal information be deleted and triggers our corresponding obligation to comply, unless exceptions apply. Note, however, that we may not always be able to comply with your request for erasure and in such circumstances, will notify our reasons to you.
  • Move, copy or export Personal Data. This is known as the Right to Portability. You have the right to request that your Personal Data be forwarded to a third party.
  • Provision/revocation of consent. You have the right to provide or decline consent to the processing of Personal Data. If you’ve already provided consent, you also have the right to revoke it. This will not impact the legality of processing prior to revocation. If you revoke your consent for the processing of Personal Data, then we may no longer be able to provide you Services. In some cases, we may deny your request to revoke consent if the law permits or requires us to do so – such as when we are unable to adequately verify your identity. You may revoke consent to processing (where such processing is based upon consent) by contacting us at the address described below.
Complaints. We are committed to resolving valid complaints about your privacy and our collection or use of your Personal Data. For questions or complaints regarding our data use practices or this Privacy Notice, please contact us as provided below. Should you remain unsatisfied with our response to your complaint, you have the right to contact your local data protection authority.
Please note that your rights are not absolute, meaning that in some circumstances, exceptions exist under applicable law. The law may provide exemptions from requests involving your Personal Data. For example, in order to provide our Services to you, deleting your Personal Data may prevent you from accessing or using such Services.
You may exercise these rights by contacting us at [email protected]. We will respond to any such request in a timely manner as specified by the GDPR. If we need more time to fulfill your request, we will let you know in advance. We will not exceed the legally specified time limit under any circumstance.
Note that, as required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name or other account information. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our files.
In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf. You must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us.
10. International Data Transfers
Our company operates globally and has a global infrastructure. We may store or process your Personal Data in various countries, including the United States, Canada and the European Economic Area (“EEA”), depending on the type of Personal Data processed. If you visit our Websites or use our Services from locations outside of the United States, please note that any information you provide to us through your use of our Websites or Service may be transferred to and processed in countries other than the country from which you accessed our Websites or Services.

Talent.com does not knowingly collect Personal Data from children under the age of thirteen (13). If we learn that we have collected personal information from a child under age thirteen (13), we will delete such information as quickly as possible. Our policies are in place to help ensure a positive experience for all parties involved in our Publisher and API programs. All publishers are required to adhere to the following terms. If you, as a publisher, fail to comply with any of these terms without permission from TALENT.COM INC, we reserve the right to suspend and close your account and cancel any scheduled payments immediately without further notice or official notification. Once your account is disabled, you may not be eligible for further participation in our publisher program.
Because our policies are subject to change at any time, please check the current page for update. It is your responsibility to keep up to date with, and adhere to, the policies listed here. Exceptions to these policies are permitted only with authorization from TALENT.COM INC.
1. What does a publisher do?
Publishers are third-party entities from whom TALENT.COM INC buys traffic, as part of our traffic acquisition strategy. They publish our content on their website and send their visitors to our pages in exchange for a click-based rate which may vary depending on numerous factors, including the publisher’s country or exposure.
Our relationship with publishers is primarily a partnership, meaning all parties involved shall benefit from it. Publishers must guarantee that they will bring quality traffic to our website, meaning all users browsing their websites must show genuine interest when clicking on our links and, hence, must agree to being redirected on our website and browse our content. Any publisher that does not follow these guidelines may be exposed to severe consequences, such as account cancellation or disabling.
2. Invalid and misleading traffic: what is it and how do we prevent it?
TALENT.COM INC treats policy violations and invalid traffic very seriously in order to protect job seekers, publishers, and advertisers. We pay close attention to traffic behavior by analyzing all clicks to determine whether they fit a pattern of use that might artificially drive up an advertiser’s costs or a publisher’s earnings.
More specifically, we sample part of the traffic to measure what we call “Intent of Apply” (IOA) which corresponds to the percentage of people who show genuine interest in applying on a given job. This is the most accurate indicator of users’ IOA as it requires them to fill out a quick form, showing they are interested in applying for the job they are reading about. The industry average is 10%, meaning for every 100 visitors, 10 are usually willing to fill the form in order to access the employer’s website. If a publisher’s IOA rate goes under a certain percentage, it triggers a quality assurance (QA) process, where we look for any invalid or misleading traffic sources, such as:
  • Adult content websites;
  • Malicious websites;
  • Malware websites;
  • Pop-under traffic;
  • Iframed traffic; and
  • Bulk unrelated traffic.
If the majority of your traffic comes from any of the aforementioned channels we will consider it as invalid, as it does not bring quality traffic to our website and interferes with our site navigation. Please be advised that we will consider this as a violation of our agreement and will proceed to suspend or close your account without further notice. We will also cancel any scheduled payment and reimburse all other parties impacted by your traffic, if any.
