GENERAL DESCRIPTION:

The University of Guam seeks an executive who is interested in new challenges and opportunities for professional and personal growth and who is interested in working in a dynamic, multi-cultural institution of higher education in the Pacific.

The General Counsel serves as the chief legal officer of the University whose primary function is to advise the President and other officers on a wide range of legal matters having legal significance to the management and operation of the University. The General Counsel will be responsible for reviewing and drafting legal documents, monitoring relevant federal and local statutes, administrative regulations and court decisions. The General Counsel reports directly to the President.

CHARACTER OF DUTIES:

Primary duties and responsibilities shall include, but not be limited to the following:

To advise the President and other officers on a wide range of legal matters having legal significance to the management and operation of the University; To represent the University before courts and administrative tribunals; To assist in the conduct of internal University administrative processes; To participate in guiding strategy for University labor negotiations and relations with collective bargaining representatives; To monitor and oversee the activities of outside counsel, as may be required; To review and draft contracts and University policies; To monitor and advise on legal obligations and compliance with the myriad of federal and local laws affecting higher education; To monitor legislative bills impacting education and the University; To represent the University when dealing with vendors, citizens’ groups and other entities having legal business with the University; To proactively reduce litigation and the risk of liability by preventing or minimizing legal risks in the daily business of the University; and Perform other duties as assigned.

MINIMUM KNOWLEDGE, SKILLS AND ABILITIES:

Knowledge of local and federal labor and employment laws as it relates to higher education; Familiarity with higher education issues; Familiarity with local and federal government structure and processes; Knowledge of personal computer applications and on-line legal research; Knowledge of contract law; Ability to analyze situations, develop solutions and provide leadership and direction; Skill in written and interpersonal communication; and Ability to work independently and within administrative and/or court-ordered timelines.

QUALIFICATIONS:

Minimum:

Juris Doctorate degree Five (5) or more years experience in the practice of law; Knowledge of Guam law and policies; and License to practice law on Guam by the Supreme Court of Guam or ability to achieve licensure consistent with Guam law regarding the temporary admission of government attorneys.

Preferred:

Demonstrated experience in state agency and/or higher education issues; Experience with federal and/or local procurement; Knowledge of personnel matters including faculty relations, university governance, and collective bargaining; Familiarity with budgets and strategic plannings; and Familiarity with alternative dispute resolution methods.

Police and Court Clearance: Pursuant to Public Law No. 28-24 and Executive Order 2005-34, applicants selected for a position are required to provide original police and court (Superior Court of Guam) clearances of no more than three (3) months old prior to commencement of employment. Off-island applicants must obtain clearances from their place of residence. Applicants are responsible for fees associated with obtaining the clearances.

WORK ELIGIBILITY:

Submission of completed job applications authorizes the University of Guam to seek and obtain information regarding the applicant’s suitability for employment. All factors which are job related may be investigated (i.e., previous employment, educational credentials, and criminal records). All information obtained may be used to determine the applicant’s eligibility for employment in accordance with equal employment opportunity guidelines. In addition, the applicant releases previous employers and job related sources from legal liability for the information provided.

Should an applicant be convicted of any crimes other than a minor traffic violation, all applicable information must be provided in the form of a police clearance report and court clearance report. Failure to admit any felony convictions may result in immediate disqualification or disciplinary action.

Section 25103, Chapter 25, Title 10 of the Guam Code Annotated requires college or university employees to undergo a physical examination, to include a test for tuberculosis (skin or x-ray), prior to employment and at least annually thereafter. A report of such examination must be conducted by a licensed physician within a state or territory of the United States and must be submitted upon request.

Federal law requires presentation of eligibility to work in the United States within seventy-two (72) hours of reporting for employment. Specifically, 8 USC 1324A requires the employer to verify the identity and eligibility to work in the United States of all newly hired employees. The University of Guam is required to comply with this law on a non-discriminatory basis. If you are hired to fill a position with the University of Guam, you will be required to present valid documents to comply with this law.

Due to budgetary constraints, UOG is not able to pay the additional application cost of $100,000 as required by the U.S. Presidential Proclamation for any applicants that will require an H1B Visa to legally work at UOG.
