Job description

Overview

Under the direction of the City Manager, and the City's attorney, the individual in this position will serve as prosecuting attorney for the City and is responsible for performing criminal and civil legal work as needed on behalf of the City. All work is performed within the policy guidelines of the City Manager and applicable law.

Responsibilities

Serve as prosecuting attorney in criminal misdemeanor cases filed by the City; represent the City in bench and jury trials, pre-trials, arraignments, sentencing, traffic violations and other misdemeanor and gross misdemeanor cases; represent the City in civil matters such as forfeitures or code enforcement.
Charge criminal cases filed by the City; review and prepare case information and review probable cause; perform discovery, investigate cases, and interview witnesses; analyze evidence and the law; develop trial or motion strategies; attempt to resolve cases without necessity of trial if appropriate; perform jury and bench trials, including preparation of motions and jury instructions related to the case.
Communicate with witnesses, police, other attorneys, and defendants as needed; communicate and coordinate with court administrative personnel, City departments, public defenders and other personnel in matters related to criminal cases.
Participate in pre-trial conferences and in-court hearings to potentially resolve cases prior to trial; negotiate, review cases, make offers, investigate, and extend offers; place dispositions on the court record.
Organize case information and analyze pertinent case facts and evidence; research legal precedent and develop arguments as appropriate; prepare and supervise the maintenance of criminal case records and other legal documents required to proceed with criminal cases.
Analyze and evaluate the validity of each criminal charge; perform a variety of case preparation duties such as reviewing and signing citations and long form complaints; plea bargaining, negotiating and interviewing witnesses.
Perform legal research and prepare opinions related to various legal issues; prepare and draft ordinances and resolutions, contracts and other legal documents and instruments.
Represent the City or assist in its representation in court on contested hearings and other infractions as required.
Perform appellate work as needed; research and prepare briefings and present oral arguments in court hearings as required.
Serve as prosecuting attorney for the City in jury and bench trials and other court and administrative hearings regarding infraction, misdemeanor, and gross misdemeanor cases, and related civil matters as needed.

Education and Experience Requirements

Juris Doctor (J.D.) from an accredited college or university school of law.

Licensed to practice law with the Washington State Bar Association.

Active membership in good standing with the Washington State Bar Association at all times during employment.

One (1) year of prior experience as a law clerk or legal intern is preferred.

Knowledge, Skills, and Abilities

Maintain knowledge of current laws, court rules, court opinions and legal issues related to the prosecution of court cases.

Knowledge of the Revised Code of Washington, Rules of Professional Conduct, Washington Administrative Code, various federal codes and the City of Airway Heights Municipal Code.

Municipal Court rules and procedures.

Legal research methodology using paper-bound and computer-based libraries.

Municipal government organizational structure, operations, policies, objectives and jurisdiction.

Criminal and civil court procedures and case decisions in Washington.

Legality and preparation of various documents and instruments.

Litigation, negotiation and trial techniques and skills.

Conflict management skills.

Strong oral and written case presentation skills.

Organization, analysis and evaluation of case facts and legal precedents.

Prosecution forms, office and court procedures.

Communicate effectively both orally and in writing.

Read, interpret, apply and explain codes, rules, regulations, policies and procedures.

Demonstrate effective interpersonal skills using tact, patience and courtesy at all times.

Establish and maintain cooperative and effective working relationships with co-workers, other City employees, City departments, vendors, local agencies and providers and the general public.

Demonstrated ability to positively and effectively interact with diverse communities to accomplish a common goal.

Paid Holidays : 11 paid holidays and 4 personal holidays per year.

Paid Time Off (PTO) : The purpose of PTO is to compensate employees for absences due to injury, illness, vacation and personal business. In addition, the program is designed to provide employees with personal flexibility regarding the use of leave hours. PTO hours accrue based upon the actual number of regular hours worked.

Year 1-4 = 8 hours / month

Year 5-10 = 11 hours / month

Year 11-15 = 13 hours / month

Year 16+ = 15 hours / month

Sick Leave : Employees will accrue 10 hours of sick leave every month.

Retirement Plan : All retirement plans are through the State of Washington Department of Retirement Systems (DRS).

Medical, Dental & Vision Insurance : The City currently pays the entire medical, dental and vision insurance premiums for the employee. Employees pay for dependent coverage / premiums.
