Summary

AC Transit is currently seeking candidates for the position of Attorney III. Under general direction, this position performs a broad range of complex professional legal work on behalf of the District, with a primary focus on defending the District in personal injury lawsuits.

This is the fully experienced level classification and third-level in the flexibly staffed Attorney series. Performs professional legal work for a broader range of increasingly complex legal matters and assists the General Counsel in implementing the Districts legal and risk management programs with a greater degree of independence. Responsible for providing counsel on and appropriate responses to legal actions including preparation and / or review of legal documents, provision of legal advocacy, and legal representation; acts as a legal resource on a variety of legal matters. Performs work that is varied, requiring considerable discretion and independent judgment to ensure efficient and effective litigation and / or resolution of legal matters. This is an unrepresented at-will classification.

Representative Functions

  • Investigates, researches, and prepares oral and written advice to the Board of Directors and District personnel on complex legal matters affecting a public transit district.
  • Oversees all phases of assigned legal matters and litigation involving the District, including investigations, pleading, discovery, depositions, hearings, arbitrations, trials, and appeals.
  • Drafts and analyzes resolutions, memoranda, contracts, and other legal documents.
  • Exercises discretionary and independent judgment commensurate with the acquisition of specialized legal skills and experience.
  • Represents the District in administrative hearings.
  • Negotiates, prepares, drafts and reviews agreements, preliminary reports, title policies, grant proposals, Board reports, letters, licenses, interagency cooperative agreements, contracts, deeds, leases, ordinances, resolutions, legislation, and other legal documents and instruments; offers opinions as to legal adequacy.
  • Advises District personnel on general liability risk management matters including contractual risk and assessment of first-party and third-party liability claims.
  • Under direction, provides expert legal supervision to investigations, fact-finding, depositions, and other activities required in connection with negotiations or litigations.
  • Represents the District, and its officers and employees, in litigation including preparation of pleadings, briefs, and other litigation documents, court appearances, motion practice; partners with and supports outside counsel representing the District.
  • Monitors and analyzes current legislation, regulations, administrative and case law for impact on District business and operations.
  • Represents the General Counsels Office at various Board of Directors and committee meetings.
  • Serves as a liaison for the legal program with other District departments and outside agencies.
  • Conducts settlement negotiations and recommends settlement amounts and details to the General Counsel or Assistant General Counsel.
  • Assists Department Heads and staff in establishing operational policies by developing and applying legal analysis; recommends changes to department policies and procedures to meet changing legal requirements.
  • Meets and negotiates with outside parties in matters arising out of claims, property transactions, and other District business.
  • Attends and participates in professional group meetings; stays abreast of new trends and innovations in the field of public agency law.
  • Performs related duties as required.

Minimum Qualifications

Education : Possession of a Juris Doctor (JD) degree from an accredited school of law.

Experience : Five (5) years of recent and verifiable experience as a practicing attorney in civil or government law; demonstrated trial experience including at least two (2) years that involved responsibilities at a level equivalent to the Districts classification of Attorney II.

License and Certification(s) : Possession of an active membership in good standing with the State Bar of California.

Special Requirements : (1) Must be able to travel throughout the Bay Area and within subpoena distance for trials, hearings, depositions, and arbitrations. (2) Must be able to attend meetings outside of regular business hours.

Additional Information

Physical Requirements : Must maintain the physical condition necessary to : (1) perform tasks in an office setting operating a personal computer, keyboards, and other peripheral equipment; and (2) possess physical mobility in order to attend off-site trials, hearings, negotiations, and to attend external meetings and events.

    Pension : All AC Transit employees participate in a lifetime defined benefit pension. All employees hired on or after January 1, 2020, may be in the Districts Tier II pension plan covered by the Public Employees Pension Reform Act of 2013 (PEPRA).
