Our client, the largest intercity bus company in New York state, is looking for an in house counsel to add to their team in Hurley, New York. This role requires a meticulous legal expert who can provide strategic advice across multiple areas, including labor relations, contract negotiations, and regulatory compliance. The ideal candidate will have experience with labor and employee relations experience and EEOC.
KEY RESPONSIBILITIES :
This position will provide counsel, support, and oversight in the following areas :
- Negotiation, interpretation, and application of eight collective bargaining agreements
- Oversight and administration of human resource policies including :
Annual sexual harassment and other mandatory trainings
Agency submissions (EEOC / AA, SSPP / PTASP, Emergency Response Plans, etc.)
Hiring, onboarding, and orientation materials
Drafting disciplinary, discharge, and counseling letters
Drafting, reviewing, and revising record retention and other company / departmental policies and memos
Federally regulated drug and alcohol testing procedures and related programs
Management of outside legal counsel including litigation management and managing Canadian outside counsel related to operations in Montreal and OntarioLegal counsel and drafting / reviewing all correspondence related to Operations, Safety, Fleet Maintenance, and Customer Care DepartmentsTriennial submissions and federal and state triennial auditsRegulatory waivers (i.e. FMCSA, FTA)Contract review including insurance indemnification clausesCollaboration on cybersecurity and technology / data privacy requirementsInsurance litigation and management of insurance company-appointed counselDrafting various correspondence as neededLicensed attorney with at least 3 years of legal experience requiring attention to detail.Proven expertise in corporate law, including contract negotiation and drafting.Familiarity with labor relations and collective bargaining agreements.Strong understanding of regulatory compliance and audits.Experience managing external legal counsel and litigation processes.Ability to handle sensitive matters related to employee relations and human resources.Knowledge of insurance law and indemnification clauses.Effective communication and drafting skills for legal correspondence across departments.
