Job description

Overview

The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.

Pay : $83,522.92 Annually

Position Summary : The primary duty of the position is to represent the State of Florida in all federal habeas cases in federal court.

Qualifications

  • Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

Preference may be given to applicants with postconviction and / or habeas experience.

The Work You Will Do

This position's duties include but not limited to the following :

  • This position requires a degree of Bachelor of Laws or Juris Doctor from an accredited law school and membership in the Florida Bar.
  • The duties incident to an appeal include supervision of the timely filing of pleadings and documents comprising the record on appeal; review of the assignments of error; research to prepare and file briefs for the State of Florida; oral argument and other responsibilities in the prosecution of criminal appeals.
  • Federal Habeas Corpus Proceedings : Represent the appropriate state official in habeas corpus proceedings filed by state prisoners in the federal courts in the District Courts for Florida.
  • Respond to claims of prisoners asserting federal constitutional rights violations, review of related state proceedings, and preparation of necessary pleadings and exhibits; handling of hearings and post-trial proceedings.
  • Handle appeals from the foregoing proceedings to the United States Court of Appeals for the Eleventh Circuit and to the United States Supreme Court.
  • Extraordinary Writs : Handles extraordinary litigation in both state and federal courts where appropriate; handle other special assignments or duties as assigned by the Bureau Chief including civil litigation, special projects, post-conviction litigation and opinions.
