Compliance Analyst II
This position exists to protect public health, safety, and welfare by regulating the practice of medicine through licensure, discipline, and education. This position supports the agency's mission by performing moderately complex compliance analysis that involves examining, evaluating, and monitoring programs, policies, and documents to ensure licensee compliance with laws, rules, terms, and conditions for Licensees that are under orders from the Texas Medical Board, Texas Physician Assistant Board, Texas Acupuncture Board, Texas Medical Radiologic Technology Board, and the Texas Respiratory Care Board. Works independently under moderately supervision prioritizing workload and monitoring the compliance status of licensees within the established regulatory requirements under the direction of the Compliance Director. This position exercises independent judgment in interpreting regulatory requirements, compliance status, and identifying violations, while monitoring corrective actions within established statutes, rules, and agency policies.
Principal Job Duties and Responsibilities:
- 60% Independently monitors and evaluates licensees' compliance with Board order terms and requirements, statutes, rules, and regulatory requirements. Meets with licensees in person or via TEAMS to evaluate the requirements of each specific Board order; independently prepares and submits timely compliance reports; identifies, documents, and submits information for review by Board representatives for the purpose of addressing issues related to the licensee's compliance with a board order; and presents evidence or testimony at administrative hearings related to a Licensee's violation of an order for cases that directly impact licensure status and public safety. Prioritizes and manages a caseload independently to meet deadlines and program requirements. Cases are generally assigned within a specific geographical area but may be assigned cases outside the compliance region. Works under limited supervision with considerable latitude for the use of initiative and independent judgement.
- 20% Interprets Board orders and monitoring conditions to determine licensee compliance. Determines compliance status, identifies violations, and initiates the corrective action plan with the Licensees adopted by Board. Reviews, analyzes, and verifies compliance documentation, reports, and support records. Prepares and responds to electronic correspondence in a timely manner. Maintains telephonic communication with the licensees as necessary. Maintains the required electronic file documentation for each licensee in their caseload. Prepares detailed, and timely compliance reports, summaries, and correspondences. Monitors and submits accurate and timely reports as required for Licensees in their caseload.
- 15% Prepares and/or presents evidence, findings, or testimony during administrative or compliance proceedings, hearings, or Informal Settlement Conferences (ISC) to Board representatives.
- 5% Performs related work as assigned.
Required Experience and Education:
- Education: Graduation from standard high school or equivalent is required. Graduation from an accredited four-year college or university with major course work in criminal justice or related field preferred. An equivalent combination of education and experience may be substituted on a year for year basis.
- Experience: Experience performing advanced compliance, regulatory, investigative, enforcement, or probation monitoring work requiring independent judgement is required. Experience in preparing formal reports and maintaining detailed case documentation is required. Experience in testifying and presenting findings during administrative hearings or compliance proceedings is preferred. Experience in health care is preferred. Experience working with other regulatory professionals and state and local authorities involved with enforcement actions or program compliance regulated by TMB is preferred. Must be able to work independently as a field staff employee with minimal supervision.
Knowledge, Skills, and Abilities:
- Knowledge of state and federal regulatory laws affecting the practice of medicine and the Texas Medical Board.
- Knowledge of Investigative methods, documentation standards, records management, court procedures, and rules of evidence.
- Knowledge of confidentiality and data privacy requirements.
- Skills in conducting investigations and/or medical record review.
- Skill in analyzing and interpreting Board orders, statutes, rules, and compliance requirements.
- Skill in using Sequel, Laserfiche, SharePoint, and standard office software.
- Skill in conducting compliance meetings and interviews with licensees in person or via virtual platforms (e.g. Microsoft Teams).
- Skills in compiling, evaluating, and presenting relevant data gathered through investigation or review.
- Skills in preparing clear, accurate, and timely compliance reports and written correspondence and skill in preparing detailed, comprehensive, and defensible written investigative reports and documentation.
- Skill in verbal communication which includes conducting compliance meetings and presenting findings.
- Skill in time management and prioritizing caseload independently.
- Ability to analyze compliance documents.
- Ability to independently evaluate compliance and make sound recommendations.
- Ability to obtain expert testimony regarding standards of medical care or verification of compliance.
- Ability to professionally manage difficult or non-compliant licenses.
- Ability to maintain confidentiality and handle sensitive information appropriately.
- Ability to communicate effectively both orally and in writing with licensees, attorneys, Board staff, and leadership.

Work Environment Requirements:
- Due to office space limitations, the principal job functions may be performed in a home-based office environment that requires:
- Regular and punctual attendance Monday Friday.
- Must respond to internal and external communications in a timely manner which is at least:
- Within 72 hrs (3 business days) of when external communication is received.
- Within 24 hrs (1 business day) of when internal communication is received.
- Within 15 minute while working remotely during business hrs if contacted by your Manager unless you are on a pre-approved leave or on a recognized lunch or exercise break.
- Frequent use of personal computers, copiers, printers, and telephones.
- Frequent sitting.
- Frequently working under deadlines, as a team member, and in direct contact with others.
- Compliance with all agency policies and procedures, including but not limited to applicable confidentiality, security and safety rules, regulations and standards.
Physical Requirements and/or Working Conditions:
- The principal job is performed in a standard office and requires:
- If temporarily working remotely due to limited office space, applicants must have a dedicated, quiet, and secure workspace that ensures privacy and minimal distractions to maintain confidentiality while working remotely.
- If temporary working remotely due to limited office space, an applicant must have reliable and secure high speed internet access with a minimum of 20 MBPS download and 2 MBPS upload.
- Applicants may be required to provide confirmation from the area ISP.
- All applicants will have frequent use of keyboard, mouse, and other input devices.
- All applicants need to have the ability to participate in video calls, phone calls, and virtual meetings.
- All applicants may experience frequently working under deadlines, individually or as a team member, and at times may collaborate with others to meet deadlines.
- All applicants may generally experience low physical demands, occasional lifting of equipment up to a certain weight (e.g. 10-40 lbs.).
Legal Requirements:
- In accordance with state law, authorization for telework may not be awarded to an employee as a condition of hiring.
- Proof of Selective Service for registration or exemption is required for males between the age of 18-25 prior to hire date.
- A new employee must complete department probationary training period before evaluation for a telework agreement.
