Job Description and Duties
Working with the California Department of Education’s (CDE) Legal Office presents a unique opportunity for the successful applicant to be part of a team that serves the legal needs of all of the department, covering all aspects of education law from early education, to special education to state special schools.
The position works directly with clients, legal management, attorneys and administrative staff facilitating requests for legal advice and assisting with Public Records Requests.
The Legal Office is embarking on an effort to modernize its software and there is an opportunity for the successful candidate to use project management skills to act as an interface between the Legal Office and the external implementation team and the CDE’s Technology Division.
On a daily basis, this position will interact directly with all of the CDE clients to analyze the legal requests, clarify the client needs and assist with the assignment of the legal issues to the CDE attorneys.
The types of legal issues are varied each day and can include clients seeking assistance with interpreting statutory or regulatory language, needing assistance with special education administrative hearings, seeking clarification of general state administrative matters, or they may be cutting-edge constitutional issues that have a potential to be decided by the federal appeals courts or the Supreme Court of the U.
S. The successful applicant will assist with department-wide coordination of the CDE clients’ efforts to respond in a timely and legally compliant manner to Public Records Act requests.
This will require collaboration with Legal Office management, the attorneys in order to assist clients who must prepare written responses to requesters.
It will include analyzing the application of PRA law to the facts and circumstances related to the particular Request; in consultation with attorneys, analyzes responsive documents to determine if they should be withheld or redacted in whole or in part based on attorney-client privilege, deliberative process privilege, privacy, or other reasons;
prepares reports analyzing the efficacy of the CDE’s system for responding to PRA requests, including recommendations for continuous improvement.

Working Conditions
TELEWORK OPTION
Hybrid : This position is headquartered in Sacramento and may be eligible for a hybrid telework schedule for eligible applicants residing in California.
A hybrid telework schedule includes working remotely and physically reporting to the office.
