Overview

Introduction

Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, fight fraud, and protect consumers in the First State.

Attorney General Kathy Jennings is supported by teams of lawyers and staff in the Criminal, Civil, Family, Fraud and Consumer Protection, and Civil Rights and Public Trust Divisions. The Office of the Attorney General includes more than 500 staff dedicated to serving Delawareans with integrity and passion. Deputy Attorneys General, with support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure public access to open government, protect the abused, and much more.

Summary statement

The Delaware Department of Justice seeks a Legal Assistant (Paralegal) to provide support to Deputy Attorneys General in the Criminal Division, Appeals Unit. While the Appeals Unit has state-wide responsibility, this position will be located in New Castle County. Appeals Deputy Attorneys General are responsible for appellate and other post-conviction litigation of criminal cases in state and federal courts. They serve as chief courtroom lawyers for the State before the state supreme court and federal appellate courts, provide guidance and research assistance to trial attorneys, and help develop professional development and legal training materials for Criminal Division personnel.

This Legal Assistant will prepare and file legal documents, conduct research, and assist with writing, filing pleadings, motions, and discovery, in pre-trial, trial, and post-trial matters. Preparation of documents for filing includes typing and transcribing handwritten documents. The Legal Assistant will assist attorneys at court hearings and will prepare and maintain court scheduling lists and court dockets and perform other related duties as assigned.

The position requires excellent organization and communication skills and regular communication with the courts where Appeals practice occurs and with opposing counsel.

This is a Casual / Seasonal position which is a non-pension eligible position without healthcare and / or other benefits. This position is currently approved for up to 29.75 hours per week.

Essential Functions

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list. Incumbents may perform duties of similar kind not specifically listed here.

  • Acts in liaison capacity between superiors and various interested parties, judicial / court staff, clients, defendants, plaintiffs, victims, witnesses, law enforcement, officials, and the public to gather, clarify and provide information regarding case facts and status.
  • Establishes and maintains case files with complete and accurate information for each step of proceedings from pre-hearing through trial and sentencing.
  • Interviews involved parties to gather discovery material and evidence for case preparation and to complete legal documents.
  • Reviews reports and information (police, medical, retail, surveillance, electronic documents, body worn camera / video); summarizes details for Deputy Attorneys General; drafts answers to complaints and responses; issues subpoenas; serves and prepares discovery; applies redactions as needed.
  • Reviews case law, statutes, regulations, and legal articles to ensure proper citation; provides written details of similar cases and memoranda of law.
  • Prepares legal pleadings (briefs, motions, indictments, information, and appeals).
  • Provides reports and recommendations for new or revised operating policies and procedures.
  • Reviews state and federal codes, laws, rules, regulations, policies, and procedures to ensure compliance of legal actions and processes.

Job Requirements

Legal Assistant I

  • Three years of employment with the Department of Justice in a similar capacity, OR
  • Possession of an associate's degree or certificate in Paralegal Studies from an ABA or Department approved program, OR
  • A bachelor's degree in criminal justice or a related field, OR
  • Three years' experience in preparing and maintaining legal documents and case files, three years' experience in legal research, three years' experience in interpreting laws, and two years' experience in drafting legal documents and in interviewing.
  • Legal Assistant II

  • Five years of employment with the Department of Justice in a similar capacity, OR
  • Possession of an Associate's degree or certificate in Paralegal Studies, OR
  • Two years' experience in preparing and maintaining legal documents and case files, two years' experience in legal research, two years' experience in interpreting laws, two years' experience in drafting legal documents, and two years' experience in interviewing; OR
  • Possession of a bachelor's degree in criminal justice or a related field with corresponding experience (as detailed in the original posting).
  • Legal Assistant III

  • Possession of an Associate's degree or certificate in Paralegal Studies or a bachelor's degree in criminal justice or a related field, OR
  • Five years' experience in preparing and maintaining legal documents and case files, five years' experience in legal research, five years' experience in interpreting laws, five years' experience in drafting legal documents, and five years' experience in interviewing; OR
  • Possession of a Juris Doctorate degree or
  • Three years' experience in preparing and maintaining legal documents and case files, three years' experience in legal research, three years' experience in interpreting laws, two years' experience in drafting legal documents, and two years' experience in interviewing.
